Code of Administrative Offenses


The Code of Administrative Offenses (CoAO) - is a codified normative act regulating public relations for bringing to administrative responsibility, as well as establishing general principles, a list of all administrative offenses.

 

Chapter 1. Basic provisions:

1.1 Persons who violate the rules are liable in accordance with applicable law.
1.2 Ignorance of the rules does not absolve you of responsibility.
1.3 Compliance with the Code of Administrative Offenses is monitored by police officers.

Chapter 2. Administrative offenses in the field of road traffic:

2.1 Driving in a state of alcoholic or drug intoxication, the offender will be deprived of his driver's license.
2.2 Driving a vehicle in the oncoming lane, the offender is obliged to pay a fine of $500 or will be deprived of his driver's license.
Notice: if a citizen has not grossly violated this article (he has not completely driven into the oncoming lane), he will be fined. If a citizen grossly violated this article (drove completely into the oncoming lane) or did not obey the legal requirements of an officer, his driver's license is withdrawn.
2.3 Violation of parking rules, the offender is obliged to pay a fine of $300 or will be deprived of his driver's license.
Notice: it is important to take into account that parking is a technical term that means the regular transfer of a vehicle to an inoperative, fixed position in a secure place provided for this. Parking is a deliberate stopping of the movement of a vehicle for more than 5 minutes for reasons not related to the embarkation and disembarkation of passengers, loading and unloading of the vehicle.
2.4 Driving in places not designated for this, the offender is obliged to pay a fine of $300.
2.5 Obstruction of traffic on the roadways of the state while driving, the offender is required to pay a fine of $250.
2.6 Ignoring the siren or obstruction of the movement of a car with a flash lights while driving, the offender is obliged to pay a fine of $300.
2.7 Ignoring the requirement to stop while driving, the offender is obliged to pay a fine of $200.
2.8 Committing an accident while driving, the perpetrator is obliged to pay compensation to the victim.
2.9 Leaving the scene of an accident while driving, the offender is required to pay a fine of $300.
2.10 Interfering with other road users when reversing while driving, the offender is obliged to pay a fine of $200.
2.11 Hitting a pedestrian while driving, the offender is required to pay a fine of $400.
2.12 Using of communications while driving, the offender is obliged to pay a fine of $100.
2.13 Creating an emergency situations on the road as a pedestrian, the offender is required to pay a fine of $300.
Notice: creating an emergency situation is AFK on the road, running out onto the road directly while traffic is moving on it, jumping under the wheels of a car, etc.
2.14 Walking on the carriageway in places not intended for this, the offender is obliged to pay a fine of $300.
2.15 Creating an emergency situations on the road while driving, the offender is obliged to pay a fine of $300.
Notice: the creation of an emergency situation is AFK on the road, intentional obstruction to traffic, undercutting, etc.
2.16 Driving a vehicle without a valid license, the offender's transport is sent to a fine at the police department's parking lot, after which the offender is obliged to pay a fine of $500.
2.17 Driving a vehicle without license plates, the offender's vehicle will be sent to a police department parking fine, after which the offender will be required to pay a fine of $300.

Chapter 3. Administrative offenses infringing on the rights of citizens and public morality:

3.1 Insulting a citizen in any form, the offender is obliged to pay a fine of $400.
Notice: an insult can be inflicted in the form of an utterance (verbally, in writing) or in the form of an action (spitting, indecent gesture), this is an attempt to become personal when communicating in any form.
3.2 Using of profanity, the offender is obliged to pay a fine of $400.
3.3 Discrimination, that is, violation of the rights, freedoms and legitimate interests of a person and a citizen, depending on his sex, race, skin color, nationality, language, origin, property, family, social and official status, age, place of residence, attitude to religion , beliefs, affiliation or not belonging to public associations or any social groups, the offender is obliged to pay a fine of $500.

Chapter 4. Administrative offenses against the management order:

4.1 Knowingly calling the police officers, the offender must pay a fine of $300.
4.2 Carrying out activities without a special permit (license), if such a permit (license) is required, the offender is obliged to pay a fine in the amount of $1,000.
4.3 Creation of an organization without obtaining a license to work and operate from the mayor and the implementation of any activity by this organization, the organizer must pay a fine of $1,200, and the accomplices or intermediaries must pay $500.

Chapter 5. Administrative offenses infringing on public order and public safety:

5.1 Hooliganism, that is, gross violation of order in a public place, the offender is obliged to pay a fine of $300.
Notice: an example of hooliganism is being on the roof of a car, being on the roof of a stop, jumping on cars, flooding into a chat with the same message.
5.2 Hooliganism, as a result of which damage was caused to other people's property, both public and private, the offender is obliged to pay a fine of $300 (According to the Administrative Code 5.1), as well as pay compensation to the victim.
Notice: If the intruder knocks down a pole, breaks a parking lot, etc., then in this case he pays a fine to the PD officer. That is (300 + 100-200), at the discretion of the officer.
5.3 Fights or waving fists in a public place, each offender who participated in this very fight is obliged to pay a fine of $400.
Notice: If a weapon was used during a fight, then in this case it is already an article of the Criminal Code of SA.
5.4 Violation of the rules of attendance at the hearing, the offender is obliged to pay a fine of $400.

Chapter 6. Administrative offenses in the field of aircraft control:

6.1 Driving an aircraft by a person under the influence of alcohol or drugs, the offender is obliged to pay a fine of $1,500.
6.2 Landing an aircraft in crowded places, or in public places, which could lead to injury to others, damage to other people's and / or state property, as well as obstruction in traffic and / or restricting the freedom of movement of citizens, the offender is obliged to pay a fine in in the amount of $1,000.
Notice: An example would be a place near a town hall / hospital or other congestion area.
6.3 Parking the aircraft in places not designated for this, the offender is obliged to pay a fine of $500.
Notice: Inappropriate places are roads, parking lots for cars and / or two-wheeled vehicles, sidewalks, squares and / or landmarks, railway tracks, bridges of any size, as well as roofs of residential buildings that are not intended for landing aircraft.
6.4 Creating an emergency situations while flying the aircraft, the offender is obliged to pay a fine of $800.
Notice: An emergency situation can be considered a situation in which physical injury was inflicted, or damage to someone else's and / or state property.
6.5 Ignoring legal landing requirements while flying the aircraft, the offender must pay a fine of $500.
6.6 Flying the aircraft in places not intended for this, the offender is obliged to pay a fine in the amount of $1,000.
Notice: An example would be road and / or rail tunnels and the space under a bridge.

Chapter 7. Administrative offenses in the field of scooter management:

7.1 Driving a scooter on the road, a citizen is obliged to pay a fine of $350.
Notice: Scooters are only allowed to move on sidewalks and roadsides.
7.2 Leaving a scooter on the roadway, thereby interfering with car drivers, he will be obliged to pay a fine of $300.
Notice: If the SAPD employee did not personally see that the scooter was thrown, then he cannot issue a fine.
Notice: If the SAPD employee did not fine the citizen immediately, and the scooter disappeared, but the fact was recorded, then the citizen is still obliged to pay the fine.
7.3 Driving a scooter, became the culprit of an accident, then he will be obliged to pay compensation to the car driver in the amount of $200.
Notice: If an accident occurred on the roadway, then the SAPD employee is allowed to issue a fine under clause 7.1.
7.4 Ignoring the special siren. services or obstruction of the movement of a car with flashing beacons while driving a scooter, the offender is obliged to pay a fine of $300.
Example: During the movement of the convoy, a citizen began to cross the street, thereby interfering with the movement of the convoy.
Notice: In some cases, it is allowed to add a penalty under clause 7.1.
7.5 Leaving the scene of an accident while driving a scooter, the offender must pay a fine of $200.
Chapter Notes:
1) To drive a scooter, you do not need licenses, certificates of completion of any courses, rights, therefore, for violations of the provisions of the Code of Administrative Offenses, citizens cannot be deprived of a driver's license.
2) Due to the fact that the rental of scooters is short-term, SAPD employees are required to conduct a more detailed and rigid video recording.

Chapter 8. Administrative offenses in the field of water transport management:

8.1 Driving water transport in a state of alcoholic or drug intoxication, the driver must pay a fine of $1,500.
8.2 Evasion of the driver, from undergoing a medical examination for intoxication, entails a fine of $500.
8.3 Violation of the rules for the carriage of passengers - the driver is obliged to pay a fine in the amount of $1,500 or more.
8.4 Disobeying the legal request of a SAPD FBI representative while driving water transport - the driver must pay a fine of $2000.
8.5 Mooring in the wrong (not designated for this) water transport, the driver is obliged to pay a fine of $1000.
8.6 Creating traffic accident while driving a water transport, the driver is obliged to pay compensation to the injured party.
8.7 Driving water transport in non-designated places (public beaches, artificial reservoirs), the driver is obliged to pay a fine of $3000.
8.8 Lack of life-saving equipment (lifejackets / rings, first aid kit, fire extinguisher) on the vessel, the driver is obliged to pay a fine of $1000.
8.9 Illegal entrepreneurial activity, while driving water transport - a fine of $2,000 is imposed, followed by withdrawal of the license and imprisonment in accordance with the Criminal Code.

 

Note to the Code of Administrative Offenses:


• Refusal to pay a fine, the offender is punished in accordance with Article 20.3 of the Criminal Code. If the offender refuses to pay a fine for violation of Articles 2.2, 2.3, 2.4, 2.7, 2.8, 2.10, 2.12, 2.14 or refuses to pay compensation for violation of Article 2.9, in addition to punishment in accordance with Article 20.3 of the Criminal Code, the offender's driver's license will be withdrawn.
