I - Human rights and obligations


1.1 All people are born equal, free and have their own personal rights, which are given to them by the Constitution and protected by the State.
1.2 The penalties must be commensurate with the violation or misdemeanor of the person, as well as must not violate state laws and regulations.
1.3 Everyone is guaranteed the right to inviolability of the person, home, papers and property from unjustified searches and arrests.
Note: This right may be partially violated if there is a search or arrest warrant. A warrant must be issued only if there are substantial grounds and evidence confirming the need for detention, search or arrest.
1.4 The grounds for detaining a person may be: violation of the Criminal or Administrative Code, violation of the rules of order and morals in a public place, as well as delivery to the police department for identification or clarification of circumstances.
1.5 Each head of any organization when issuing a reprimand or warning is obliged to write it down in a certain document within a day, if there is no record during the day in which the punishment was issued, then it is invalid.
1.6 An employee of any organization has the full right not to comply with orders or decrees of higher management or superiors in the event that this order or decree forces you to violate a law or legal act, or humiliates you as a person or oppresses your rights, which are given to you by the constitution. Exception: Emergency or special operation.
1.7 An employee of a state organization has the right to apply for transfer to another organization in accordance with the current state transfer system.
1.8 Each head or head of a state organization has the right to submit a request to the government office for the payment of material allowances that are necessary for payments to subordinates or for other expenses related to the performance of official duties by the head and subordinates.
1.9 An employee of any organization has the right to receive a monthly vacation, for a period of no more than 10 days. In case of violation of the leave period, the employer reserves the full right to dismiss this employee.


II - Legislative power


2.1 All legislative powers hereby established belong to the Governor and the Council of Ministers.
2.2 In the event of the removal of the Governor from office, death, resignation or for other reasons, the inability to perform the duties of the governor, they are performed (in order of seniority, starting from 1 to 5):
1) Deputy Governor;
2) Minister of Inner Security;
3) Minister of Defense;
4) Minister of Health;
5) Minister of Communications.
2.3 Each bill put forward by the Council of Ministers, before it is adopted, is sent to the Governor or Deputy. To the Governor in the absence of the Governor for further review and adoption process.
2.4 In the absence, incapacity or death of a minister who is a member of the Council of Ministers, a deputy Minister from among the inspectors of the Ministry is appointed to the position of this Minister, with the consent of the Council of Ministers.
2.5 Only the Governor of a State has the right to amend, supplement, or otherwise edit the Criminal Code, Administrative Code, or Constitution, if the Council of Ministers and the Cabinet of the State have approved the amendments, additions, or revisions of these legislative acts.

III - Executive and representative power

 

3.1 Before taking office, the Governor takes the oath in the following form: "I solemnly swear that I will faithfully perform the duties of Governor, and to the best of my ability, I will uphold, protect, and defend the Constitution of the United States."
3.2 The Governor is the commander-in-Chief of the state army and police, who are called up for active service.
Note: The Governor may request the opinion of senior officials on any matter relating to their official duties, and he is also granted the right to delay the execution of sentences and the right to pardon for crimes against the United States of America.
3.3 The Governor appoints judges and all other officials of the state government apparatus, as well as is their direct supervisor.
3.4 Governor, Deputy The Governor and all civil officers of the United States may be removed from office for treason, bribery, or other serious crimes and misdemeanors.
3.5 Authorized agents of the Federal Bureau of Investigation have the right to listen to telephone conversations and correspondence on the basis of violations of the Criminal or Administrative Codes, as well as if there is a corresponding warrant.
3.6 The head of each state organization is obliged to monitor its employees and their work, to engage in the performance of their duties on an equal basis with them, as well as to improve and improve productivity and working conditions in their organization.

 

IV - Judicial power


4.1 The judicial power of the United States is vested in the court.
4.2 The judicial power extends to all cases that are tried under the common law and the law of equity and arise under this Constitution, the laws of the United States, and treaties.
4.3 The Court is an independent authority and reports only to the Governor. Court decisions are considered superior to decisions of various organizations and other authorities.


V - Constitution


5.1 The Council of Ministers may, if two-thirds of the members deem it necessary, propose amendments to this Constitution, which shall take effect in all respects as part of this Constitution after their ratification.
Note: The Council of Ministers should not issue any law relating to the establishment of religion, or prohibiting its free practice, or restricting the freedom of speech or the press, or the right of the people to assemble peacefully and to petition the Government for the satisfaction of complaints.
5.2 The enumeration in the Constitution of certain rights should not be interpreted as negating or detracting from other rights reserved to the people.
5.3 The State Constitution has the highest legal force, direct effect and applies throughout the state. Laws and other legal acts adopted in the state must not contradict the State Constitution.
